- § 1 Rental object
- (1.1) The advertiser lets the following property (rental object) as tourist accommodation to the tenant: Apartment Vistamar, Calle Vistamar 150, 03726 Cumbre del Sol (Benitachell, Alicante, Spain), Registry number VT-443245-A as advertised in the website https://www.apartment-vistamar.com/ for a total of {Adults} adults and {Children} children. The rental property is a non-smoking property. No daily housekeeping service. This is a self-catering apartment: During the stay there is no daily cleaning service or change of bed linen and towels. The use of washing machine, iron, hoover, broom and dustpan is provided.
- (1.2) The rental property is fully equipped and furnished as is let with the following furnishings:
- 1 spacious living / dining room furnished with a dining table and chairs , sofa and a coffee table. Baby chair available on request.
- 2 bedrooms with spacious wardrobes : 1 bedroom with double bed of 150×190 and window to the terrace, and 1 bedroom with 2 beds of 90×190. Bed linens provided.
- living room has patio doors opening onto the terrace furnished with an awning, patio table and chairs, parasol and 2 sun loungers.
- Flat screen satellite TV with Apple TV and radio
- Air conditioning hot & cold
- Kitchen with dishwasher, microwave, ceramic hob, oven, coffee machine, toaster, kettle, electric juicer, fridge and freezer.
- Washing Machine, iron & ironing board.
- 1 bathroom with shower, hairdryer and towels.
- (1.3) The tenant is entitled to use the following equipment / furnishings during the rental period:

- Awning, patio table and chairs, parasol and 2 sun loungers
- Flat screen satellite TV.
- Air conditioning hot & cold
- Kitchen with dishwasher, microwave, ceramic hob, oven, coffee machine, toaster, kettle, fridge and freezer.
- Washing Machine, iron & ironing board.
- Hairdryer and towels.
- Community pool
- Parking on the street
- (1.4) The tenant receives for the duration of the rental period : one apartment key, one key for the metal front door and one community pool key.

- § 2 Rental period, Arrival and Departure
- (2.1) The rental property is let to the tenant from {Start Date} (arrival date) until {End Date} (departure date).
- (2.2) Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
- (2.3) Check-in Policy : The arrival time on the arrival day is after 16:00 o’clock.
- Before arrival the Tenant should confirm the expected arrival time at least with one hour in advance.
- Upon arrival the property manager will give the keys to the Tenant and show and explain everything important to the apartment.
- (2.4) Check-out Policy : The checkout time on the day of departure is until 10 o’clock.
- (2.4.1) The rental contract shall be automatically terminated without any notice on {End Date} at 10:00 am.
- (2.4.2) The tenant shall leave the property in similar condition as found, leaving it free from personal belongings and in perfect condition all available services, furniture and fittings mentioned in point § 1 (2). There is no possibility of extension of the rental contract except by written agreement between the parties. Any additional cleaning costs by the Advertiser may be transferred to Tenant at its discretion.
- (2.4.3) Before departure the Tenant should be sure to do the following:
- Return the keys to the property Manager
- Take out all trash to the dumpster.
- Empty the refrigerator.
- Lock all doors and close all windows.
- § 3 Rental price and payment methods
- (3.1) Rental price for {Number of Nights} nights: {Total Amount} €

- 25% deposit of {Deposit – First Payment} at the tirme of reservation

- (3.5) If the duration between the date of signing the contract and the start date of the rental period is less than 30 days, then the total amount is payable immediately.

- (3.7) If the tenant is more than 7 days late in paying, then the advertiser is entitled to terminate the contract immediately and without notice and let the property to someone else
- (3.1) Rental price for {Number of Nights} nights: {Total Amount} €
- § 4 Security deposit refund and deductions policy
- (4.1) The security deposit will be returned to the Tenant on departure day by Credit card, PayPal or wire transfer provided the following provisions are met:
- No damage is done in the property or its contents beyond normal wear and tear.
- All debris, rubbish and discards are placed in rubbish bin, and soiled dishes are placed in the dishwasher and cleaned
- No linens, bath or pool towels are lost or damaged
- (4.2) Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Advertiser shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings.
- (4.3) Non-exhaustive itemized list of deductions from the security deposit :
- Pool key loss : 100 € replacement charge
- If the router is reseted : 45 € charge for the router reconfiguration.
- (4.4) Supplements:
- Pet fee: 35 € per stay
- Full equiped cot: 4€ per day
- High chair: 2,50€ per day
- Extra linen package (bed linen, towels): 7,50 € per person
- (4.1) The security deposit will be returned to the Tenant on departure day by Credit card, PayPal or wire transfer provided the following provisions are met:
- § 5 Pet policy :
- (5.1) Some pets are welcome with prior approval.
- (5.2) Pet owners are liable for damages caused by their animals
- (5.3) Pets owners are responsible for cleaning up any/all pet refuse.
- (5.4) Pets are not allowed on furniture at any time
- (5.5) Pets must not be left in the apartment alone
- § 6 Cancellation and early termination
- (6.1) Cancellation requests have to be submitted by email at apartment.vistamar@gmail.com. The date applicable is the day the document is received by the advertiser.
- (6.2) If the tenant terminates their stay early, they are still responsible to pay the full rental price.
- (6.3) Termination is only accepted in writing. The date applicable is the day the document is received by the advertiser.
- (6.4) Booking deposit refund terms :
- Fully refundable booking deposit up to 4 (four) weeks prior to the beginning of the rental period.
- 50% deposit refund up to 2 (two) weeks prior to the beginning of the rental period.
- If the balance is not paid on time, the booking will be automatically cancelled and the deposit cannot be refunded.
- If the cancellation is due to force majeure resulting from an outbreak of Covid 19 in Benitachell or in the tenant’s home town which prevents him/her from travelling, the amount paid for the reservation will be reimbursed in full, without it being necessary to observe a cancellation period.
- § 7 Liability and Responsibilities of the Tenant

- (7.1) The rental property incl. the furniture and the other contents are to be treated with care. The tenant is held responsible for the actions of other people within the house. The tenant is liable for all damaged goods, damage to the property or anything else related to the property, whether caused by themselves or their accompanying guests.
- (7.2) Faults that are found before or during the rental period are to be reported to the advertiser immediately.
- (7.3) Animals are allowed with prior consent from the advertiser.
- (7.4) Use of the pool at your own risk.
- (7.5) House rules: the tenant agrees to observe following house rules.
- Please respect the community’s rest hours from 22:00 to 8:00.
- Use the air conditioning responsibly and turn it off when no one is in the apartment. The recommended comfort temperature is 25ºC. We reserve the right to apply a supplement for excess consumption.
- Oven: Please clean the oven after each use. Otherwise we reserve the right to charge an extra cleaning fee of € 25.
- This is a no smoking apartment.
- Be sure to lock both front doors when leaving the apartment.
- Bath and pool towels shouldn’t be washed with bleach.
- Please use the bath towels only in the apartment and do not take the pool towels to the beach.
- Always use duvets and pillows with their covers.
- Do not take sunbeds from the terrace to the pool
- Do not reset the router
- If there is a strong breeze, the awning should not be used.
- Due to the humidity and in order to avoid condensation damage, we kindly ask you to ventilate the apartment twice a day, especially in winter.
- Rubbish: Place your rubbish in the bins located 50 m behind the last house on Vistamar Street. Bottles, glass and paper should be deposited in the containers located in Polígono Encinas street. It is not allowed to leave any rubbish or plastic bags inside the apartment or in the street, on the pavement, in the corridors or outside the front door.
- Please do not sit on the couch when covered in sunscreen.
- (7.6) Pet policy rules § 5 .
- (7.7) Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Quiet hour starts at 10 PM.
- § 8 Contract wording and clause
- (8.1) Changes and alterations of this contract need to be in writing.
- (8.2) If some of the legal requirements of this contract are inoperative or impractical, or become so after completion of the contract, the effectiveness of this contract will not be affected. At the point of inoperative or impractical legal requirements the individual should reach an agreement that comes as close as possible to the economic goals that the parties of the contract tried to achieve.
- (8.3) This contract shall be governed by Spanish law and the Spanish courts shall have jurisdiction. The territorial jurisdiction shall correspond to the court of the place where the services are provided or the court of the defendant’s domicile.
Both parties ratify the present contract and sign it in duplicate, for one and the same purpose, at the place and on the date indicated in the heading.
